What if I make a mistake?
If you hire someone that you believe is an independent contractor but later is determined to be a worker/employee, then you will be responsible for all past worker/employee benefits, payroll taxes, and penalties established by law.
 
State agencies have differing criteria concerning noncompliance. Please visit each agency’s Web site for agency-specific information.

ORS 670.600 applies only to the Oregon Department of Revenue, Employment Department, Construction Contractors Board, and Landscape Contractors Board. These agencies require that the person performing the work must meet all the criteria of that law.
